You must be at least 21 years of age to purchase alcoholic beverages through the Website.

A valid government-issued photo identification may be required upon delivery. Alcohol will not be delivered to anyone under 21 years of age.
Alcoholic beverage laws vary by state and locality. Wine Anthology ships alcoholic beverages only to destinations where we determine shipment is permitted and may change available shipping destinations at any time based on applicable laws, regulations, licensing requirements, carrier requirements, or operational considerations.

To the extent permitted by applicable law, title to products purchased from Wine Anthology passes to the purchaser in the State of New Jersey upon completion of the sale.
Where permitted by applicable law and applicable to the transaction, the purchaser authorizes Wine Anthology to arrange shipment of purchased products through an authorized common carrier on the purchaser's behalf.

Customers are responsible for complying with laws applicable to their possession, receipt, and use of products purchased from Wine Anthology.
Alcohol shipments require an adult signature from a person 21 years of age or older at delivery.
Carriers may require valid government-issued identification to verify the recipient's age.
Packages containing alcohol will not be left unattended where an adult signature is required.
If delivery cannot be completed because an eligible adult is unavailable, additional delivery attempts, return shipping, reshipping charges, restocking charges, or other fees may apply where permitted by law.

Wine Anthology will collect and remit taxes when required by applicable law.

Additional charges may apply when an order is returned because of an incorrect address, failed adult-signature delivery, or other circumstances attributable to the recipient.

Customers may request that an order be held because of weather conditions when that option is available.

Weather-related holding periods, limitations, or fees will be governed by policies communicated at the time of purchase or contained in our Shipping & Returns Policy.
Returns, refunds, replacements, and damaged-product claims are governed by our current Shipping & Returns Policy and applicable law.
Customers should inspect shipments promptly and contact Wine Anthology as soon as reasonably possible regarding missing, incorrect, or damaged products.
Certain alcoholic beverages may be subject to restrictions on returns or exchanges under applicable law.
Nothing in these Terms limits rights that cannot legally be waived.

ANY LIMITATION OF LIABILITY WILL APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Except for disputes that qualify for small claims court or claims for which arbitration cannot lawfully be required, any dispute, claim, or controversy arising out of or relating to these Terms, your use of WineAnthology.com, your account, or any purchase or transaction with Wine Anthology shall be resolved through binding individual arbitration rather than in court.
Before initiating arbitration, the party asserting a claim must first provide the other party with written notice describing the dispute and relief requested.
The parties agree to make a good-faith effort to resolve the dispute informally for at least 30 days following receipt of the notice before commencing arbitration.

If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with the applicable AAA Consumer Arbitration Rules, as modified by these Terms.
The arbitrator shall have authority to award the same individual remedies that would otherwise be available in court to the extent permitted by applicable law.
The Federal Arbitration Act shall govern the interpretation and enforcement of this arbitration provision.
YOU AND WINE ANTHOLOGY AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING, TO THE FULLEST EXTENT PERMITTED BY LAW.
Unless both parties agree otherwise, the arbitrator may not consolidate the claims of more than one person or preside over a representative, class, collective, consolidated, or mass proceeding.
Either party may bring an eligible individual claim in small claims court instead of arbitration, provided the claim remains within that court's jurisdiction and proceeds on an individual basis.
Arbitration may be conducted remotely, by telephone, through written submissions, or in person as permitted by applicable AAA rules and law.
If an in-person hearing is required, it shall take place in Union County, New Jersey, unless applicable law or arbitration rules require another location or the parties agree otherwise.
Payment of filing, administration, and arbitrator fees shall be governed by applicable AAA rules and law.
Wine Anthology will pay arbitration fees it is legally required to pay.
Each party shall otherwise be responsible for its own attorneys' fees and costs unless applicable law or another enforceable agreement permits an award of attorneys' fees or costs.
For disputes not subject to arbitration, you and Wine Anthology consent, to the extent permitted by law, to the jurisdiction of appropriate state or federal courts located in New Jersey.
Nothing in these Terms prevents either party from seeking temporary or preliminary injunctive relief from a court of competent jurisdiction when permitted by law.
Nothing in this Section is intended to waive or limit a right or remedy that cannot lawfully be waived or limited.
If a particular portion of this arbitration provision is determined to be invalid or unenforceable, that portion shall be severed or limited to the minimum extent necessary and the remainder shall continue in effect, except where applicable law requires otherwise.
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
Wine Anthology's failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.
Wine Anthology may update these Terms periodically.
When changes are made, the “Last Updated” date at the top of this page will be revised.
Material changes will be communicated as required by applicable law.
Where applicable law requires affirmative consent to a change, continued use of the Website alone will not substitute for such consent.
